Elements Mountain Compost – Terms and Conditions

1. Introduction
These Terms and Conditions (“Terms”) govern all compost collection
services and compost product sales (“Services” and “Products”) provided
by Elements Mountain Compost
(“Elements,” “we,” “our,” or “us”). By subscribing to or purchasing any
of our Services or Products, the customer (“Customer,” “you,” or “your”)
agrees to these Terms.
2. General Terms for All Services
2.1 Accepted Materials
Customers must only include approved organic materials
in their compost bins or drop-off containers. Accepted and prohibited
materials are listed on our website and may be updated periodically.
Approved:
food scraps, coffee grounds, plant trimmings, and BPI-certified compostable food-service packaging.
Prohibited: plastics, metal, glass, cardboard,
stickers, animal feces, personal hygiene products, rocks, dirt,
branches, and paper leaf bags.
2.2 Contamination Policy
Excess contamination may result in skipped service with no credit
issued. A contamination fee may be applied after the first warning.
2.3 Liability
Elements Mountain Compost is not liable for any incidental or
consequential damages arising from the use or misuse of our services,
containers, or compost products. Customers agree to indemnify and hold
harmless Elements Mountain Compost, its employees, and agents from any
claims arising from failure to comply with these Terms.
2.4 Payment and Fees
All services and products must be paid for in accordance with the
payment schedule provided at the time of purchase or subscription.
Elements reserves the right to suspend or terminate services for
non-payment or repeated contamination.
3. Residential Drop-Off Service
3.1 Service Description
The Drop-Off Service allows residential customers to bring approved
organic materials to designated Elements Mountain Compost locations.
3.2 Drop-Off Access
Customers must follow posted signage and staff direction at all
times. Yard waste materials must be bagged in plastic or compostable
bags only. No paper leaf bags are allowed.
3.3 Fees and Payment
Food waste drop-off access requires a subscription. Yard waste and
event waste drop off may be scheduled by appointment only for a one-time
fee. Payment is due in full at the time of purchase or renewal. No
refunds or pro-rated discounts will be issued for early cancellation of
subscriptions.
3.4 Contamination
Customers who repeatedly bring contaminated materials may have their access privileges revoked without refund.
4. Modifications and Termination
Elements Mountain Compost reserves the right to modify these Terms,
service schedules, or pricing with reasonable notice. Continued use of
our Services constitutes acceptance of any updates.
5. Governing Law
These Terms shall be governed by and construed in accordance with the
laws of the State of Colorado. Any disputes shall be resolved in the
courts of Chaffee County, Colorado.
